2016-1098 COUNTY INITIATED ZONING AMENDMENT FOR : The County proposes to approve to rezone APN 042-015-029 from R3-PD (Multi-Family Residential- Planned Development) to C2 (General Commercial). The subject property is located at 10 Main Street in San Andreas. APN: 042-015-029 is located in San Andreas Townsite, Portion of Block 16.
A previously adopted ordinance (Ordinance 1554) set forth the zoning classifications within the San Andreas Community Plan Area (Zoning Amendment 1361). The October 1982 zoning map correctly identifies the proposed zoning for APN 042-015-029 as C2. However, APN 042-015-029 was zoned R3-PD in error and adopted by the County. Adoption of this ordinance is only for the purpose of rectifying a clerical error in Ordinance 1554.
The proposed rezone is exempt from CEQA Section 15061 (b)(3). The activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA.
NOTICE IS HEREBY GIVEN that the Calaveras County Planning Commission will conduct a public hearing on November 10, 2016 at 9:00 a. m. or soon thereafter to consider the above referenced project. The public hearing will be held in the Calaveras County Board of Supervisors Chambers, Government Center, 891 Mt. Ranch Road, San Andreas, California.
Pursuant to Government Code 65009, if anyone challenges the above listed issues in a court of law, the challenge may be limited to raising only those issues you or someone else raise at the public hearing described in this notice, or in written correspondence delivered to the Commission, at or prior to, the public hearing. You are welcome to review the application at the Calaveras County Planning Department during normal working hours, 8:00 a. m. to 4:00 p. m., Monday through Friday except county holidays.
