This <a id=\"CP___PAGEID=329524|\" href=\"http:\/\/www.insurance.ca.gov\/0250-insurers\/0300-insurers\/0200-bulletins\/bulletin-notices-commiss-opinion\/upload\/bulletin-2021-06-moratorium.pdf\">Order<\/a>\u00a0protects those living within the perimeter or adjoining ZIP Code of a declared wildfire disaster regardless of whether they suffered a loss, including the Dixie, Caldor, River, Tamarack, Antelope, McFarland, Monument, Fly, and Cache fires.<\/p>\n<p><a href=\"http:\/\/www.insurance.ca.gov\/\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/dailytide.com\/wp-content\/uploads\/2021\/09\/cadeptins.png\" alt=\"\" width=\"225\" height=\"225\" class=\"alignnone size-full wp-image-11264\" \/><\/a><\/p>\n<p>\u201cClimate change-fueled wildfires continue to devastate homeowners and communities. My moratorium orders help provide short-term relief as we address the root causes of these ever-intensifying natural disasters,\u201d said Commissioner Lara. \u201cThis California law empowers my office to help give people the breathing room they desperately need as they recover. I will both continue to enforce this law to protect consumers and continue working to create long-term solutions.\u201d<\/p>\n<p>The Commissioner&#8217;s ability to issue moratoriums is a result of a California law he authored in 2018 while serving as state senator in order to provide temporary relief from non-renewals to residents living within or adjacent to a declared wildfire disaster.<\/p>\n<p>Today\u2019s moratorium order follows Governor Gavin Newsom&#8217;s six emergency declarations this summer and gives protection from insurance company-initiated non-renewals for one year for residential property insurance policies in ZIP codes within or adjacent to the fire perimeter. Today\u2019s declared moratorium includes Governor Newsom\u2019s\u00a0<a href=\"https:\/\/www.gov.ca.gov\/wp-content\/uploads\/2021\/07\/7.23.21-SOE-Dixie-Fly-Tamarack.pdf\">July 23<\/a>,\u00a0<a href=\"https:\/\/www.gov.ca.gov\/wp-content\/uploads\/2021\/08\/8.5.21-River-and-Antelope-SOE.pdf\">August 5<\/a>,\u00a0<a href=\"https:\/\/www.gov.ca.gov\/wp-content\/uploads\/2021\/08\/8.10.21-Monument-_McFarland_Dixie-Fire.pdf\">August 10<\/a>,\u00a0<a href=\"https:\/\/www.gov.ca.gov\/wp-content\/uploads\/2021\/08\/8.17.21-Caldor-Fire-Proclamation.pdf\">August 17<\/a>,\u00a0<a href=\"https:\/\/www.gov.ca.gov\/wp-content\/uploads\/2021\/08\/8.30.21-Caldor-Fire-SOE.pdf\">August 30<\/a>, and\u00a0<a href=\"https:\/\/www.gov.ca.gov\/wp-content\/uploads\/2021\/09\/9.7.21-Cache-Fire-SOE.pdf\">September 7<\/a>\u00a0Declarations affecting parts of Alpine, Amador, Butte, Calaveras, El Dorado, Glen, Humboldt, Lake, Lassen, Mendocino, Modoc, Mono, Nevada, Placer, Plumas, Shasta, Sierra, Siskiyou, Tehama, Trinity, Yolo, and Yuba counties. Consumers\u2019 one year of protection from non-renewal starts on the date of the Governor\u2019s emergency declaration that included the fire affecting them.<\/p>\n<p>Today&#8217;s\u00a0<a id=\"CP___PAGEID=329524|\" href=\"http:\/\/www.insurance.ca.gov\/0250-insurers\/0300-insurers\/0200-bulletins\/bulletin-notices-commiss-opinion\/upload\/bulletin-2021-06-moratorium.pdf\">order<\/a>\u00a0protects 325,000 policyholders and is in addition to 25,000 policyholders who were protected in the Commissioner\u2019s moratorium order following the\u00a0<a id=\"CP___PAGEID=328540,release086-2021.cfm,1734|\" href=\"http:\/\/www.insurance.ca.gov\/0400-news\/0100-press-releases\/2021\/release086-2021.cfm\">July 23 wildfire emergency<\/a>\u00a0in Lassen, Plumas, and Siskiyou counties.<\/p>\n<p>Consumers can go to the California\u00a0<a id=\"CP___PAGEID=321594,MandatoryOneYearMoratoriumNonRenewals.cfm,1134|\" href=\"http:\/\/www.insurance.ca.gov\/01-consumers\/140-catastrophes\/MandatoryOneYearMoratoriumNonRenewals.cfm\">Department of Insurance website<\/a>\u00a0to see if their ZIP Code is included in the moratorium. Consumers should contact the Department of Insurance at 800-927-4357 or via chat or email at\u00a0<a id=\"CP___PAGEID=272871,index.cfm,1126|\" href=\"http:\/\/www.insurance.ca.gov\/01-consumers\/101-help\/index.cfm\">insurance.ca.gov<\/a>\u00a0if they believe their insurance company is in violation of this law, or have additional claims-related questions.<\/p>\n<p>The Commissioner&#8217;s action is part of a larger solution he is pursuing for consumers and wildfire survivors that includes working to increase insurance protections and market competition to help protect consumers. Commissioner Lara\u2019s actions since taking office in 2019 include:<\/p>\n<ul>\n<li><a id=\"CP___PAGEID=324150,release023-2021.cfm,1734|\" href=\"http:\/\/www.insurance.ca.gov\/0400-news\/0100-press-releases\/2021\/release023-2021.cfm\">Introduced rules<\/a>\u00a0that would allow consumers to obtain their home or business\u2019s \u201cwildfire risk score\u201d from their insurance company and require that they receive credit for actions they have taken to make their properties safer.<\/li>\n<li><a id=\"CP___PAGEID=323452,release012-2021.cfm,1734|\" href=\"http:\/\/www.insurance.ca.gov\/0400-news\/0100-press-releases\/2021\/release012-2021.cfm\">Created a partnership<\/a>\u00a0with CAL FIRE, the Governor\u2019s Office of Emergency Services (CalOES), and other state agencies to establish achievable, science-based home-hardening measures would allow more people to qualify for an insurance discount or other incentive.<\/li>\n<li><a id=\"CP___PAGEID=327197,release078-2021.cfm,1734|\" href=\"http:\/\/www.insurance.ca.gov\/0400-news\/0100-press-releases\/2021\/release078-2021.cfm\">Sponsored new insurance protections<\/a>\u00a0signed into law by Governor Newsom \u2014 despite opposition from insurance companies \u2014 that will mean larger payouts for some claims, less red tape from insurance companies, and more help for people under evacuation orders.<\/li>\n<li><a id=\"CP___PAGEID=310376,release099-19.cfm,1547|\" href=\"http:\/\/www.insurance.ca.gov\/0400-news\/0100-press-releases\/2019\/release099-19.cfm\">Ordered the FAIR Plan<\/a>, the state&#8217;s insurer of last resort, to offer a more comprehensive homeowners policy as an option, which\u00a0<a id=\"CP___PAGEID=327106,statement073-2021.cfm,1734|\" href=\"http:\/\/www.insurance.ca.gov\/0400-news\/0100-press-releases\/2021\/statement073-2021.cfm\">a judge recently upheld<\/a>.<\/li>\n<\/ul>\n<p>\u201cProtecting consumers is Job One,\u201d added Commissioner Lara, who traveled to 36 counties before the pandemic and held virtual meetings since then to listen to the challenges that consumers have with insurance. \u201cI am using every tool possible to protect consumers in the wake of climate change-intensified natural disasters and to stop bigger losses.\u201d<\/p>\n<p>Following Governor Newsom&#8217;s state of emergency declarations, the Department of Insurance partners with the California Department of Forestry and Fire Protection (CAL FIRE) and the Governor&#8217;s Office of Emergency Services (CalOES), pursuant to existing statute, to identify wildfire perimeters for mandatory moratorium areas. The Department of Insurance will continue to collaborate with CAL FIRE and CalOES to identify additional wildfire perimeters for any fires where there is a declaration of a state of emergency.<\/p>\n<p><strong># # #<\/strong><\/p>\n<p><strong>Media notes:<\/strong><\/p>\n<ul>\n<li>The mandatory one-year moratorium announced today covers 325,000 residential policies in ZIP codes located within or adjacent to the Dixie, Caldor, River, Tamarack, Antelope, McFarland, Monument, Fly, and Cache fires under Senate Bill 824 (Lara, Chapter 616, Statutes of 2018), also known as the Wildfire Safety and Recovery Act.<\/li>\n<li>While existing law prevents non-renewals and cancellations for those who suffer a total loss in areas subject to a declared disaster, the new law established protection for those living within or adjacent to a declared wildfire emergency of whether they suffer a loss \u2014 recognizing for the first time in law the disruption that non-renewals cause in communities following wildfire disasters.
