Boards consideration to approve an MOU with Mark Twain UESD for Extended School <\/span>Y<\/b>ear (ESY) summer program\u00a0<\/b><\/p>\n

Description<\/span>:\u00a0<\/span><\/p>\n

Due to staffing shortages for the extended school year (E<\/span>S<\/span>Y) program<\/span>, <\/span>VUSD is entering into an MOU with Mark Twain SD to meet the needs of our special education students for the <\/span>summer<\/span>.\u00a0<\/span><\/p>\n

In compliance with <\/span><\/i>the <\/span><\/i>Americans with Disabilities Act<\/span><\/i>, <\/span><\/i>for those requiring special assistance to access the Board meeting room, to acce<\/span><\/i>s<\/span>s written documents being discussed at the Board meeting<\/span><\/i>, <\/span><\/i>or to otherwise participate at Board meetings, <\/span><\/i>please <\/span><\/i>contact <\/span><\/i>the <\/span><\/i>Board Secretary Cheryl Boyd at 209-795-8503 for assistance. MEMORANDUM OF UNDERSTANDING <\/b>2022 EXTENDED SCHOOL YEAR SERVICES\u00a0<\/b><\/p>\n

This Memorandum of Understanding (“MOU”) is entered into this 13th day of June by <\/span>and between the Valle<\/b>cito Unified School District and (VUSD) and Mark Twain Union <\/span>Elementary School District (MTUESD), collectivel<\/span>y referred to as “the parties.”\u00a0<\/b><\/p>\n

    \n
  1. 1<\/b>. <\/b>Term & Effecti<\/b>v<\/i><\/b>e Date<\/b>. The term <\/b>of this MOU is June 13, 2022 – July 15, 2<\/span>0<\/span> This MOU is effective following approval by <\/span>the governing board of the Resident District. <\/b>2. <\/b>Termination. In the eve<\/b>nt that MTUESD is unable to s<\/span>taff or otherwise operate <\/b>ESY for the Resident District, this MOU may be terminated with ten (10) days written <\/span>notice to the Superintendent of VUSD. <\/b>3<\/b>. <\/b>Purpose & Obligations. <\/b>T<\/b>he purpose of this MOU is to enable VUSD to offer <\/span>Extended <\/b>School Year (ESY) services to students with a qualifying Individual Education <\/span>Plan (IEP) indicating in-person, on-site ESY at Mark Twain Elementary School.\u00a0<\/span><\/li>\n
  2. A<\/span>. <\/span>This MOU applies only to ESY for such students for <\/span>the summer ESY program operating between J<\/b>une 13, 2022 and July 15, 2<\/span>0<\/span> Mon<\/span>day – Friday <\/b>services<\/b>, 8 a.m. – noon during this period with June 20 and July 4, <\/span>o<\/b>b<\/b>served as holidays.\u00a0<\/b><\/li>\n
  3. V<\/span><\/i>USD is responsible for providing arranging and being fiscally responsible <\/span>for transp<\/span>ortation to and f<\/b>rom Mark Twain Elementary School and the point of pick-up <\/span>and drop-off that VUSD an<\/span>d parent<\/b>\/<\/i><\/b>guardian agree to.\u00a0<\/b><\/li>\n
  4. MTUSD is responsible for providing 1 breakfast, 1 lunch, and 1 snack <\/span>each day ESY is in session to the students attending from VUSD, at no cost.\u00a0<\/b><\/li>\n
  5. MTUESD may revoke the attendance of students <\/b>in its ESY for the <\/span>reason<\/b>s outlined in ED CODE 489<\/span>0<\/span>0, including, <\/span>b<\/span>ut are not limited to, for failure to <\/span>demonstrate acceptable behavior.\u00a0<\/b><\/li>\n
  6. VUSD will incur the following financial costs <\/span>for services rendered under <\/b>this MOU, regardle<\/span>ss of student attendance:\u00a0<\/b><\/li>\n<\/ol>\n

    Teacher cost per student: $990.00 <\/span>Paraprofessional c<\/span>o<\/span>st per student: $608.00\u00a0<\/span><\/p>\n

    Total Cost per student is $1598.00 due to MTUE<\/span>SD, PO BOX 1359, <\/b>681 <\/b>Tuolumne Ave, Angels Camp, CA 95222 on or before July 15, 2022.\u00a0<\/span><\/p>\n

      \n
    1. F<\/span>. This MOU is <\/span>a stand-alone agreem<\/b>ent for 2022 ESY, June 13 – July 15, 2022 <\/span>only and does not replace any other agreements to which the p<\/span>arties are signatories.\u00a0<\/b><\/li>\n
    2. Co<\/b>mpliance with law<\/b>. The parties shall be subject to and <\/b>comply with all applicable <\/span>federal, state, and local laws and regulations with respect to their performance under <\/b>this MOU, including but not limited to, a<\/span>d<\/span>opting and implementing written policies pursuant to Education Code section 517<\/span>47.\u00a0<\/span><\/i><\/li>\n
    3. Nondiscriminatory Services. The parties agree that all education services <\/b>provided under this MOU shall be available to all qualifie<\/span>d persons regardless of age<\/b>,\u00a0<\/b><\/li>\n<\/ol>\n

      sex, rac<\/b>e, religion, c<\/span>ol<\/span>or, national origin, or ethnic background, or disability, and that <\/span>none shall be used in whole or in part, for religious worship or instruction.\u00a0<\/span><\/p>\n

        \n
      1. I<\/b>ndepend<\/b>ent Cont<\/b>ractor Status<\/b>. <\/b>This MOU is by an<\/span>d between two independent <\/b>contractors and is not <\/span>in<\/span>tended to and <\/b>sha<\/b>ll not be construed to create the relationship <\/span>between t<\/b>he parties of agent, servant, employee, partnership, joint venture, or <\/span>a<\/b>ssociation.\u00a0<\/b><\/li>\n
      2. <\/b>Authorization<\/b>. The undersigned parties represent that they are authorized to <\/b>execute <\/span>this <\/span>MOU on behalf of their respective principals.\u00a0<\/span><\/li>\n
      3. Execution in Counterparts. This MOU may be executed in counterparts, each of <\/b>which will be <\/span>treated as an ori<\/b>ginal and all of which to<\/span>gether are to be considered one and the same <\/b>MOU. <\/span>F<\/span>acsimile s<\/span>ignatures or scanned c<\/b>opies of signatures are binding <\/span>and are to be considered <\/b>original signa<\/span>tures.\u00a0<\/b><\/li>\n
      4. <\/b>Signatures. <\/b>These signatures attest the parties’ agreement hereto:\u00a0<\/b><\/li>\n<\/ol>\n
