Of the 3.4 million who<br \/>\nserved in Vietnam, 58,220 never returned home and 304,000 were<br \/>\nwounded. Seventeen hundred individuals remain listed as missing or killed<br \/>\nin action. In its place were lines of protestors \u2013 unable to differentiate between<br \/>\nthe war and the troops who served. As a result of the mistreatment that<br \/>\nmany experienced upon their return, many chose to not wear their<br \/>\nuniforms, the same uniforms they had worn just days before in the jungles<br \/>\nof Vietnam with pride.<br \/>\nIn 2007, both the US Senate and the US Congress passed resolutions<br \/>\nproclaiming March 30th as National Welcome Home Vietnam Veterans<br \/>\nDay. No<br \/>\nRECOMMENDATION:<br \/>\nApprove a Professional Services Agreement with California Forensic Medical Group for a term<br \/>\nof July 1, 2015 to June 30, 2018 in the amount of four hundred eighty-five thousand eight<br \/>\nhundred eighty-one dollars ($485,881) per annum to be adjusted annually based on the<br \/>\npercentage change in the medical care component of the Consumer Price Index CPI &#8211; West<br \/>\nUrban Region for services to the Calaveras County inmate population<br \/>\nDISCUSSION\/SUMMARY:<br \/>\nThe California Board of Corrections requires provision for medical services by qualified<br \/>\nprofessionals in local detention facilities as defined in Minimum Jail Standards, Title 15 and<br \/>\nArticle 10.<br \/>\nIn April of 2015, the County advertised for Request for Proposals for qualified vendors to<br \/>\nprovide medical services for the inmate population in the Calaveras County Correctional Facility<br \/>\nfor the term of July 1, 2015 through June 30, 2018. The legal notice of the opening of the bid<br \/>\nwas advertised in multiple newspapers including all tri-county area newspapers and Central<br \/>\nValley newspapers. The County also mailed notification of the Request for Proposals for<br \/>\nmedical services to Mark Twain Medical Center, Sonora Regional Medical Center and Amador<br \/>\nSutter Hospital.<br \/>\nThe Request for Proposals closed in May of 2015 with only one bid received from California<br \/>\nForensic Medical Group (CFMG). The bid submitted met all required components of the<br \/>\nRequest for Proposals and included a fee schedule of $485,881.00 per annum to be adjusted<br \/>\nbased on the percentage change in the medical care component of the Consumer Price Index<br \/>\nCPI \u2013 All Consumers \u2013 West Urban Region.<br \/>\nThe CFMG is the current provider of medical services in the Calaveras County Correctional<br \/>\nFacility and has been the provider since May 10, 1999.<br \/>\nFINANCING:<br \/>\n5<br \/>\nPacket Pg. 11<br \/>\nJail Medical Agreement<br \/>\nMarch 29, 2016<br \/>\nFinancing for the inmate medical services contract is paid out of the Jail Budget Unit (10100380)<br \/>\nand is a direct General Fund cost. This is not recommended. The drought is causing widespread<br \/>\ntree mortality and a major bark beetle epidemic.<br \/>\nOn July 31, 2015, Governor Brown proclaimed a State of Emergency due to a series of wildfires<br \/>\nstatewide. He indicated that drought conditions have increased the State\u2019s risk of wildfires and<br \/>\ncaused millions of trees to die. On October 30, 2015, Governor Brown further proclaimed a<br \/>\nState of Emergency due to the vast tree mortality within several regions of the state.<br \/>\nAs a result of the Butte Fire, tree mortality will likely be significantly enhanced in Calaveras<br \/>\nCounty due to dead trees giving off the chemical Terpene, which attracts the bark beetle. The<br \/>\nbark beetle is responsible for the tree mortality currently being witnessed in the State, and<br \/>\nalthough the beetle is attracted to the chemical given off by the dead trees, they will only attack<br \/>\nsurrounding living trees.<br \/>\nOn November 24, 2015, the Board of Supervisors adopted the State of Emergency for<br \/>\nCalaveras County due to widespread tree mortality and a major bark beetle epidemic.<br \/>\nOn December 8, 2015, December 22, 2015, January 5, 2016, January 12, 2016, January<br \/>\n26, 2016, February 9, 2016, February 23, 2016, March 8, 2016 and March 22, 2016 the<br \/>\nBoard of Supervisors continued the State of Emergency for tree mortality.<br \/>\nThe US Forest Service and Cal Fire have reported an estimated 22 million dead trees due to the<br \/>\ndrought and bark beetles. Unless the risks posed by dead, dying and diseased trees are<br \/>\nimmediately abated, there will be a significantly increased risk to life and property (e.g. trees<br \/>\nfalling on homes), and interruption of essential services (i.e. roads, power, water, sewer,<br \/>\ncommunications). The fire has<br \/>\nalso likely damaged and\/or contaminated residential wells, and there are additional hazards<br \/>\nrelated to foods, medicines, and other perishables that have been spoiling due to the lack of<br \/>\nelectricity required for refrigeration or freezing.<br \/>\nOn September 22, 2015 the Board of Supervisors adopted a resolution proclaiming a Local<br \/>\nHealth Emergency in Calaveras County. State law requires that the declaration of a Local<br \/>\nHealth Emergency be reviewed every 14 days until the date of termination. On September<br \/>\n29, 2015, October 13, 2015, October 27, 2015, November 10, 2015, November 24, 2015,<br \/>\nDecember 8, 2015, December 22, 2015, January 5, 2016, January 12, 2016, January 26,<br \/>\n2016, February 9, 2016, February 23, 2016, March 8, 2016 and March 22, 2016 the Board<br \/>\nof Supervisors continued the Local Health Emergency.<br \/>\nThe attached Revised Declaration of Local Health Emergency allows the Environmental Health<br \/>\nDepartment, the County Health Officer, and the Calaveras Health and Human Services Agency<br \/>\nto garner much-needed resources and mutual aid to meet the health and safety needs of those<br \/>\nwho have been displaced by the fire, including those who are now anxious to return to<br \/>\nproperties which may not currently be safe for them.<br \/>\n11<br \/>\nPacket Pg. 56<br \/>\nA declaration of Local Health Emergency also authorizes the Director of Environmental Health<br \/>\nand the County Health Officer to:<br \/>\n\uf0b7 Require disclosure of any potentially toxic material that may have been released, spilled,<br \/>\nor escaped during the fire<br \/>\n\uf0b7 Transmit information about potentially toxic exposure to state or local agencies<br \/>\nresponding to the health emergency or treating its victims<br \/>\n\uf0b7 Sample, analyze, or otherwise determine the identifying and other technical information<br \/>\nnecessary to abate the hazard and protect public health<br \/>\nFINANCING:<br \/>\nContinuing the declaration of a Local Health Emergency allows the County to receive aid and<br \/>\nreimbursement it may not otherwise be qualified to receive.<br \/>\nALTERNATIVES:<br \/>\nThe Board may choose to not continue the Local Health Emergency, but this is not<br \/>\nrecommended because the continuation of the emergency allows the Health Officers to move<br \/>\nquickly to procure necessary information and resources to mitigate the hazards resulting from<br \/>\nthe fire.<br \/>\nOTHER AGENCY INVOLVEMENT:<br \/>\nEnvironmental Health, CHHSA&#8211;Public Health<br \/>\nAPPROVED BY:<br \/>\n11<br \/>\nPacket Pg. 57<br \/>\nBOARD OF SUPERVISORS, COUNTY OF CALAVERAS<br \/>\nSTATE OF CALIFORNIA<br \/>\nMarch 29, 2016<br \/>\nResolution<br \/>\nNo. (ID # 1995)<br \/>\nRESOLUTION CONTINUING THE EXISTENCE OF A<br \/>\nLOCAL HEALTH EMERGENCY JOINTLY PROCLAIMED BY<br \/>\nTHE COUNTY ENVIRONMENTAL HEALTH DIRECTOR AND<br \/>\nCOUNTY HEALTH OFFICER<br \/>\nWHEREAS, California Health &#038; Safety Code (H&#038;S) Section 101080 empowers the local<br \/>\nDirector of Environmental Health to declare a Health Emergency within the jurisdiction<br \/>\nwhenever a release, spill, escape, or entry of waste is hazardous or may become hazardous<br \/>\nbecause of a combination or reaction with other substances or materials in a manner the<br \/>\nDirector determines to be an immediate hazardous to public health; and<br \/>\nWHEREAS, Section 101080 of the California Health and Safety Code empowers the<br \/>\nLocal Health Officer to proclaim the existence or threatened existence of a local health<br \/>\nemergency when the Local Health Officer reasonably determines that the waste is a hazardous<br \/>\nwaste or medical waste, or that it may become a hazardous waste or medical, subject to<br \/>\nratification by the Board of Supervisors within seven days and reaffirmation every fourteen days<br \/>\nthereafter until such health emergency is terminated; and<br \/>\nWHEREAS, the Butte Fire has burned 818 structures, including 475 residences within<br \/>\nthe jurisdiction, giving rise to an imminent public health threat due to the burning, spilling,<br \/>\nescaping, and releasing of hazardous materials contained therein and the toxicity of the burned<br \/>\ndebris and resulting ash; and<br \/>\nWHEREAS, the Butte Fire has forced the extended evacuation of residents from<br \/>\nthousands of homes where, in combination with a loss of power to these homes, the spoilage of<br \/>\nperishable food and medical items gives rise to an imminent and proximate threat of<br \/>\ncommunicable and\/or non-communicable disease; and<br \/>\nWHEREAS, the Butte Fire is likely to have damaged, destroyed, and\/or contaminated an<br \/>\nunknown number of wells which supply drinking water at properties through which the fire has<br \/>\nburned, giving rise to an imminent and proximate threat of disease and\/or release of a chemical<br \/>\nagent or toxin; and<br \/>\nWHEREAS, the Calaveras County Health Officer does hereby find:<br \/>\n1. That conditions beginning on September 9, 2015, have created and are continuing to<br \/>\ncreate debris, which may be or which may become hazardous waste and a threat to<br \/>\npublic health; and<br \/>\n2. That the threat to public health creates the immediate need to facilitate assistance and<br \/>\nundertake preventive measures to protect the health of people and the environment and<br \/>\nto inform the affected public of any potential health issues associated with the debris<br \/>\ncreated by the Butte Fire, thereby necessitating the proclamation of the existence of a<br \/>\nlocal health emergency; and<br \/>\n3. That assistance to private property owners and to the County is needed for timely<br \/>\nimplementation of necessary preventive measures to protect public health and the<br \/>\nenvironment; and<br \/>\n4. That the scope and breadth of the Butte Fire, including but not limited to the many<br \/>\nresidences that have been damaged or destroyed creates an imminent threat to public<br \/>\n11<br \/>\nPacket Pg. 58<br \/>\nhealth in that there are apparent hazardous substances akin to any hazmat incident,<br \/>\nwhich require a rapid response to be safely removed from the sites of burned structures;<br \/>\nand<br \/>\n5. That the potential advent of the rainy season offers little time to mitigate further<br \/>\nenvironmental contamination, including contamination of the watershed, meaning that<br \/>\ntime is of the essence in removing hazardous materials from property sites; and<br \/>\n6. At that time of Mid Year Technical<br \/>\nAdjustments, there were not sufficient funds in the Duplication Fund (10100090) to cover the<br \/>\ncost of the copier so the cost of the Capital Asset was to be funded from savings from the<br \/>\nInsurance Budget Unit (10100150). With the deposit into the Duplication Fund from quarterly<br \/>\ndepartmental charges, there are now sufficient funds to pay for the copier for Human Resources<br \/>\nout of the Duplication Budget Unit.<br \/>\nThe Board also approved on March 8, 2016 the purchase of a Capital Asset for a<br \/>\ncopier\/scanner\/printer for the Assessor (10100050) during Mid Year Technical Adjustments.<br \/>\nThe Assessor is asking to increase the cost of the Capital Asset by $1,000.00 to include the<br \/>\ncost of sales tax of the Capital Asset for an amount not to exceed $13,500.00.The cost will be<br \/>\npaid by salary savings in the Assessor\u2019s budget.<br \/>\nThe Administrative Office is recommending the Board approve the purchase of the Capital<br \/>\nAsset in the Duplication Fund and to increase revenue and expenditures by $17,000.00 to the<br \/>\nDuplication Budget with a transfer from the Duplication Fund (54740000); requiring a 4\/5s vote<br \/>\nof the Board.
