The preliminary injunction was granted by the U.S.\u00a0District Court for the Northern District of California on September 18, 2023, and Attorney General Bonta\u00a0<a href=\"https:\/\/oag.ca.gov\/news\/press-releases\/attorney-general-bonta-files-notice-appeal-overturn-preliminary-injunction\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/oag.ca.gov\/news\/press-releases\/attorney-general-bonta-files-notice-appeal-overturn-preliminary-injunction&amp;source=gmail&amp;ust=1702672777587000&amp;usg=AOvVaw3rIZZLAG8bxLfd__DhacWP\">filed a notice of appeal<\/a>\u00a0on October 18, 2023.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/new.thepinetree.net\/wp-content\/uploads\/2019\/07\/cadoj.jpg\" alt=\"\" width=\"225\" height=\"224\" class=\"alignnone size-full wp-image-82791\" srcset=\"https:\/\/new.thepinetree.net\/wp-content\/uploads\/2019\/07\/cadoj.jpg 225w, https:\/\/new.thepinetree.net\/wp-content\/uploads\/2019\/07\/cadoj-150x150.jpg 150w, https:\/\/new.thepinetree.net\/wp-content\/uploads\/2019\/07\/cadoj-30x30.jpg 30w\" sizes=\"auto, (max-width: 225px) 100vw, 225px\" \/><\/p>\n<p>\u201cThe\u00a0companies\u00a0challenging\u00a0<wbr \/>this law\u00a0are doing so\u00a0because they want to continue to profit from our kids\u2019 online activity.\u00a0As the People\u2019s Attorney, and as a proud father of three, I won\u2019t stand idly by,\u201d\u00a0<b>said Attorney General Bonta.<\/b>\u00a0\u201cThe\u00a0California legislature unanimously adopted the\u00a0California Age-Appropriate Design\u00a0Code to elevate kids\u2019\u00a0privacy and safety online.\u00a0In enjoining the law, the court got this one wrong: The Age-Appropriate Design Code is\u00a0about protecting children\u2019s data, not limiting free speech. In California,\u00a0we will continue to fight to protect our kids from those who seek to exploit their childhood experiences for profit, and we urge the Ninth Circuit\u00a0to\u00a0vacate the preliminary injunction.\u201d<\/p>\n<p>The California Age-Appropriate Design Code Act is a\u00a0first-in-the-nation\u00a0law\u00a0<wbr \/>aimed at safeguarding children online, and the\u00a0Attorney General\u2019s appeal\u00a0seeks to overturn a district court decision that\u00a0preliminarily enjoined the law in response to a lawsuit brought\u00a0by an online trade association representing companies such as Google, Meta, Amazon, Twitter, and\u00a0TikTok.\u00a0The act requires that businesses that trade in consumers\u2019 personal information and offer products, services, and features likely to be accessed by children proactively protect their young users\u2019 information, and prohibits certain actions that involve the collection and use of that information.<\/p>\n<p>Authored by Assemblymember Buffy Wicks (D-Oakland) and Assemblymember Jordan Cunningham (R-San Luis Obispo), the\u00a0California Age-Appropriate Design Code Act\u00a0was\u00a0<a href=\"https:\/\/www.gov.ca.gov\/2022\/09\/15\/governor-newsom-signs-first-in-nation-bill-protecting-childrens-online-data-and-privacy\/\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.gov.ca.gov\/2022\/09\/15\/governor-newsom-signs-first-in-nation-bill-protecting-childrens-online-data-and-privacy\/&amp;source=gmail&amp;ust=1702672777587000&amp;usg=AOvVaw3iJxUWO7Bgxv-mNSRh8NzW\">signed<\/a>\u00a0into law by Governor Gavin\u00a0Newsom on September 15, 2022. The law was\u00a0modeled after the United Kingdom\u2019s Age Appropriate Design Code, which similarly requires that websites likely to be accessed by children provide privacy protections by default. The Legislature unanimously passed the law, finding that more needs to be done to create a safer online space for children to learn, explore, and play.
