Sacramento, CA…California Attorney General Rob Bonta today\u00a0issued a statement after filing an appeal\u00a0in the U.S.\u00a0Court of Appeals\u00a0for the Ninth Circuit\u00a0seeking to\u00a0reverse\u00a0a district court decision ruling that California\u2019s\u00a0prohibition on the manufacture, importation, sale, or possession of a “billy club” or baton weapon,\u00a0under Penal Code section 22210\u00a0is unconstitutional under the Second Amendment.\u00a0\u201cBilly club\u201d was the term used when the law enacted in 1923 and the current text of the law has retained that terminology.\u00a0The appeal would seek to overturn the district court decision in\u00a0Fouts v. Bonta<\/em>. Attorney General Bonta\u00a0will urge\u00a0the Ninth Circuit Court of Appeals to overturn the district court\u2019s decision, which will ensure that these\u00a0vital\u00a0public safety protections remain in place to prevent unwarranted injuries\u00a0in California communities.<\/p>\n

\u201cThe\u00a0decision to overturn an over 100-year-old law not only defies logic but contradicts\u00a0the Supreme Court\u2019s decision in\u00a0New York Rifle & Pistol Association v. Bruen<\/em>,\u201d\u00a0said Attorney General Bonta. \u201c<\/b>We have filed an appeal, as this decision puts public safety at risk. The Supreme Court was clear that\u00a0Bruen<\/em>\u00a0did not create a regulatory straitjacket for states \u2014 and we believe that the district court got this wrong. We\u00a0will not stop in our efforts to protect the safety of communities.\u201d<\/p>\n

The potential public safety risk is this new ruling would permit civilian possession of modern “billy clubs”, such as the expandable ASP baton. This baton can be concealed and used in public disturbances or riots, as it was during the\u00a0January\u00a02021 attack on the U.S. Capitol.\u00a0The plaintiffs allege that California’s prohibition on the\u00a0acquisition and\u00a0possession of batons violates the Second Amendment. In 2021, the Attorney General prevailed in the federal district court on the constitutionality of the law, and the plaintiffs appealed the decision to the Ninth Circuit. Following the Supreme Court’s decision in\u00a0New York Rifle & Pistol Association v. Bruen<\/em>,\u00a0the case was remanded to the federal district court for further proceedings.
