{"id":44569,"date":"2017-09-12T08:58:25","date_gmt":"2017-09-12T15:58:25","guid":{"rendered":"http:\/\/69.46.6.243\/?p=44569"},"modified":"2017-09-12T08:58:25","modified_gmt":"2017-09-12T15:58:25","slug":"becerra-leads-daca-lawsuit-against-trump-administration","status":"publish","type":"post","link":"https:\/\/new.thepinetree.net\/?p=44569","title":{"rendered":"Becerra Leads DACA Lawsuit Against Trump Administration"},"content":{"rendered":"<p>Sacramento, CA&#8230;California Attorney General Xavier Becerra, joined by the attorneys general for Minnesota, Maryland and Maine, filed a lawsuit against the Trump Administration over its decision to end the Deferred Action for Childhood Arrivals initiative (DACA). The four States filed the suit in the U.S. District Court for the Northern District of California arguing that the Trump Administration violated the Constitution and federal laws when it rescinded DACA.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/new.thepinetree.net\/wp-content\/uploads\/2017\/08\/Xavier_Becerra_official_portrait_as_attorney_general_of_California.jpg\" alt=\"\" width=\"220\" height=\"330\" class=\"alignnone size-full wp-image-43749\" srcset=\"https:\/\/new.thepinetree.net\/wp-content\/uploads\/2017\/08\/Xavier_Becerra_official_portrait_as_attorney_general_of_California.jpg 220w, https:\/\/new.thepinetree.net\/wp-content\/uploads\/2017\/08\/Xavier_Becerra_official_portrait_as_attorney_general_of_California-200x300.jpg 200w, https:\/\/new.thepinetree.net\/wp-content\/uploads\/2017\/08\/Xavier_Becerra_official_portrait_as_attorney_general_of_California-150x225.jpg 150w\" sizes=\"auto, (max-width: 220px) 100vw, 220px\" \/><\/p>\n<p>\u201cThe DACA initiative has allowed more than 800,000 Dreamers, children brought to this country without documentation, to come out of the shadows and become successful and productive Americans. One-in-four of those DACA Dreamers know California as home, and it\u2019s no coincidence that our great state is the sixth largest economy in the world,\u201d\u00a0<b>said Attorney General Becerra<\/b>. \u201cIn California, we don&#8217;t just support and value them \u2013 we fight for them. And it\u2019s important that we get this right. We will not permit Donald Trump to destroy the lives of young immigrants who make California and our country stronger. The court of public opinion has already spoken: the vast majority of Americans agree Dreamers should be here to stay; so now it&#8217;s time to fight in every way we can \u2013 and on multiple fronts \u2013 in the court of law.\u201d<\/p>\n<p>In the complaint, Minnesota Attorney General Lori Swanson, Maryland Attorney General Brian Frosh, Maine Attorney General Janet Mills, and Attorney General Becerra describe the several violations by the federal government of the Constitution and federal laws designed to ensure that our government treats everyone fairly and transparently. Among other things, the complaint alleges:<\/p>\n<ul>\n<li>The Trump Administration\u2019s termination of DACA and the associated Department of Homeland Security (DHS) memo and FAQs may lead to the untenable outcome that the Administration will renege on the promise it made to Dreamers and their employers that information they gave to the government for their participation in the program will not be used to deport them or prosecute their employers. The\u00a0risk\u00a0DACA\u00a0grantees face is compounded by\u00a0DHS\u2019s\u00a0earlier imposition of\u00a0boundless enforcement \u201cpriorities\u201d that sweep in most immigrants. The threatened misuse of sensitive information provided in good faith by DACA grantees to the government is\u00a0fundamentally unfair, violating the\u00a0Fifth Amendment\u2019s due process guarantee.<\/li>\n<\/ul>\n<ul>\n<li>The federal Regulatory Flexibility Act\u00a0also requires the government to analyze the effects of a proposed change on small businesses, many of which are owned by, or employ, Dreamers, and to take comments on the proposed change. The Administration completely ignored these legal requirements.<\/li>\n<\/ul>\n<ul>\n<li>The termination of DACA directly affects the substantive rights of almost 800,000 people and indirectly affects millions more, as well as small and large businesses, non-profits, and the towns, cities and states that these individuals call home. The federal Administrative Procedure Act\u00a0requires such a change to be made for sound reasons, and for the public to be able to make formal comments on it before it\u2019s made into law. Whether or not the initiative was implemented through notice and comment rulemaking, it cannot be terminated without it.<\/li>\n<\/ul>\n<p>In July, Attorney General Becerra led 20 attorneys general in\u00a0<a href=\"https:\/\/oag.ca.gov\/system\/files\/attachments\/press_releases\/7-21-17%20%20Letter%20from%20State%20AGs%20to%20President%20Trump%20re%20DACA.final_.pdf\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=https:\/\/oag.ca.gov\/system\/files\/attachments\/press_releases\/7-21-17%2520%2520Letter%2520from%2520State%2520AGs%2520to%2520President%2520Trump%2520re%2520DACA.final_.pdf&amp;source=gmail&amp;ust=1505315298618000&amp;usg=AFQjCNFsXTsCAB-_7AQgjDCob15EroqqUQ\">sending a letter<\/a>\u00a0to President Trump urging him to maintain and defend DACA.
