{"id":56937,"date":"2018-04-11T15:19:37","date_gmt":"2018-04-11T22:19:37","guid":{"rendered":"http:\/\/69.46.6.243\/?p=56937"},"modified":"2018-04-11T15:19:37","modified_gmt":"2018-04-11T22:19:37","slug":"attorney-general-becerra-sues-epa-over-once-in-always-in-policy-repeal","status":"publish","type":"post","link":"https:\/\/new.thepinetree.net\/?p=56937","title":{"rendered":"Attorney General Becerra Sues EPA Over \u201cOnce In, Always In\u201d Policy Repeal"},"content":{"rendered":"<p>Sacramento, CA&#8230;California Attorney General Xavier Becerra and the California Air Resources Board (CARB) have filed a lawsuit against the U.S. Environmental Protection Agency (EPA) over its illegal repeal of a longstanding policy that requires major sources of hazardous air pollutants \u2013 such as petroleum refineries and chemical plants \u2013 to permanently take action to reduce their emissions. Known formally as the \u201cOnce In, Always In\u201d policy, this critical guidance has been in effect since 1995. Attorney General Becerra and CARB filed the lawsuit in the D.C. Circuit Court of Appeals.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/new.thepinetree.net\/wp-content\/uploads\/2017\/08\/Xavier_Becerra_official_portrait_as_attorney_general_of_California.jpg\" alt=\"\" width=\"220\" height=\"330\" class=\"alignnone size-full wp-image-43749\" srcset=\"https:\/\/new.thepinetree.net\/wp-content\/uploads\/2017\/08\/Xavier_Becerra_official_portrait_as_attorney_general_of_California.jpg 220w, https:\/\/new.thepinetree.net\/wp-content\/uploads\/2017\/08\/Xavier_Becerra_official_portrait_as_attorney_general_of_California-200x300.jpg 200w, https:\/\/new.thepinetree.net\/wp-content\/uploads\/2017\/08\/Xavier_Becerra_official_portrait_as_attorney_general_of_California-150x225.jpg 150w\" sizes=\"auto, (max-width: 220px) 100vw, 220px\" \/><\/p>\n<p>The purpose of the \u201cOnce In, Always In\u201d policy is simple: to ensure that major sources of hazardous air pollutants install and operate equipment to permanently minimize the release of hazardous air pollutants. Major sources are those that emit or have the potential to emit 10 tons per year or more of any single hazardous air pollutant or 25 tons per year or more of any combination of hazardous air pollutants. Elimination of the \u201cOnce In, Always In\u201d policy would invite major sources of hazardous air pollutants to game air regulations and avoid important pollution-saving measures.<\/p>\n<p>\u201cInstead of prioritizing the health of hardworking Americans, EPA Administrator Scott Pruitt wants to let major polluters off the hook. That is unconscionable, and it is illegal,\u201d said Attorney General Becerra. \u201cIf the \u2018Once In, Always In\u2019 policy is rescinded, children in California and around the country \u2013 particularly those who must live near the polluting plant or factory \u2013 may grow up in an environment with tons of additional hazardous pollutants in the air they breathe. California will not allow that to happen. The EPA must be held accountable.\u201d<\/p>\n<p>California is urging the Court to invalidate EPA\u2019s repeal, because it contravenes the intent of Congress expressed in the Clean Air Act and it constitutes an arbitrary and capricious reversal of the Agency\u2019s position.<\/p>\n<p>Since taking office, Attorney General Becerra has taken swift and broad action to hold EPA Administrator Scott Pruitt accountable.
