The Army Corps\u2019 directive would drastically shorten timeframes for state water quality certifications under Section 401 of the Clean Water Act (CWA). This abbreviated timeframe would prevent states from adequately assessing the water quality impacts of proposed federal projects to ensure states\u2019 water resources are protected.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/new.thepinetree.net\/wp-content\/uploads\/2017\/08\/Xavier_Becerra_official_portrait_as_attorney_general_of_California.jpg\" alt=\"\" width=\"220\" height=\"330\" class=\"alignnone size-full wp-image-43749\" srcset=\"https:\/\/new.thepinetree.net\/wp-content\/uploads\/2017\/08\/Xavier_Becerra_official_portrait_as_attorney_general_of_California.jpg 220w, https:\/\/new.thepinetree.net\/wp-content\/uploads\/2017\/08\/Xavier_Becerra_official_portrait_as_attorney_general_of_California-200x300.jpg 200w, https:\/\/new.thepinetree.net\/wp-content\/uploads\/2017\/08\/Xavier_Becerra_official_portrait_as_attorney_general_of_California-150x225.jpg 150w\" sizes=\"auto, (max-width: 220px) 100vw, 220px\" \/><\/p>\n<p>\u201cThis directive is another egregious attempt by the Trump Administration to illegally weaken the protections afforded by the Clean Water Act,\u201d\u00a0<b>said Attorney General Becerra.<\/b>\u00a0\u201cCalifornia has an inherent right under the Clean Water Act to evaluate whether projects meet our water quality standards and to impose conditions to protect our waters.\u201d<\/p>\n<p>Under the CWA, a project requiring federal approval that may result in discharges into \u201cwaters of the United States\u201d must obtain the state\u2019s certification that the project meets state water quality standards.\u00a0Under Section 401, a state must act on a request for certification within a reasonable period of time, not to exceed one year. If the state does not act within that period, the certification requirements are waived. The Army Corps\u2019 directive seeks to drastically reduce the time period for state review from one year to 60 days, even if the request is incomplete or otherwise deficient. If implemented, the directive would deprive the nation\u2019s waters of CWA protections, because California and other states will have insufficient time to ensure that projects comply with state water quality standards.<\/p>\n<p>The multistate comment letter argues that the directive conflicts with both the CWA and the Administrative Procedure Act. By imposing a shortened 60-day default time period for states to evaluate a project and ensure compliance with state water quality standards, the directive is inconsistent with the CWA\u2019s primary objective to protect water quality.<\/p>\n<p>Joining Attorney General Becerra in writing the comment letter are the Attorneys General of New York, Colorado, Connecticut, Maine, Maryland, Minnesota, New Jersey, North Carolina, Rhode Island, Vermont, and Washington, and the Commonwealths of Massachusetts and Virginia.<\/p>\n<p>This letter builds on Attorney General Becerra\u2019s previous efforts to safeguard California\u2019s waterways. In February 2018, Attorney General Becerra, joined by 10 attorneys general,\u00a0<a href=\"https:\/\/oag.ca.gov\/news\/press-releases\/attorney-general-becerra-files-lawsuit-protect-clean-water-rule\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/oag.ca.gov\/news\/press-releases\/attorney-general-becerra-files-lawsuit-protect-clean-water-rule&amp;source=gmail&amp;ust=1556313237246000&amp;usg=AFQjCNGioIP117gu_jd-kZ1AOJqEHryUTA\">filed a lawsuit against the U.S. Environmental Protection Agency and the U.S. Army Corps of Engineers to protect the Clean Water Rule<\/a>\u00a0from suspension. In September and December, Attorney General Becerra\u00a0<a href=\"https:\/\/oag.ca.gov\/news\/press-releases\/attorney-general-becerra-opposes-trump-administration%E2%80%99s-attempt-repeal-clean\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/oag.ca.gov\/news\/press-releases\/attorney-general-becerra-opposes-trump-administration%25E2%2580%2599s-attempt-repeal-clean&amp;source=gmail&amp;ust=1556313237246000&amp;usg=AFQjCNHRDFjEvwN5YPM_gZ_uGkPxI_eu7g\">filed opposition to the Trump Administration\u2019s illegal attempt to repeal the 2015 Clean Water Rule<\/a>.
