{"id":98235,"date":"2020-03-27T21:06:47","date_gmt":"2020-03-28T04:06:47","guid":{"rendered":"http:\/\/69.46.6.243\/?p=98235"},"modified":"2020-03-27T21:38:52","modified_gmt":"2020-03-28T04:38:52","slug":"governor-newsom-grants-executive-clemency-2","status":"publish","type":"post","link":"https:\/\/new.thepinetree.net\/?p=98235","title":{"rendered":"Governor Newsom Grants Executive Clemency"},"content":{"rendered":"<p>Sacramento, CA&#8230;Today, Governor Gavin Newsom signed an executive order to enhance the authority of California\u2019s Judicial Branch to take emergency action in the face of the COVID-19 crisis.\u00a0 Specifically, the executive order empowers the Judicial Council and the Chief Justice of the California Supreme Court to take necessary action to be able to conduct business and continue to operate while responding to the COVID-19 pandemic. The order does not affect any existing court order or rule.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-98239\" src=\"https:\/\/new.thepinetree.net\/wp-content\/uploads\/2020\/03\/ExecutiveOrder-1.jpg\" alt=\"\" width=\"400\" height=\"225\" srcset=\"https:\/\/new.thepinetree.net\/wp-content\/uploads\/2020\/03\/ExecutiveOrder-1.jpg 640w, https:\/\/new.thepinetree.net\/wp-content\/uploads\/2020\/03\/ExecutiveOrder-1-300x169.jpg 300w, https:\/\/new.thepinetree.net\/wp-content\/uploads\/2020\/03\/ExecutiveOrder-1-123x70.jpg 123w, https:\/\/new.thepinetree.net\/wp-content\/uploads\/2020\/03\/ExecutiveOrder-1-570x320.jpg 570w\" sizes=\"auto, (max-width: 400px) 100vw, 400px\" \/><\/p>\n<p>The order allows the Judicial Branch to allow for remote depositions in every case (the law had previously required that parties be deposed in person) and electronic service of process. Additionally, the order leaves the Judicial Branch discretion to make any modifications to legal practice and procedure it deems necessary in order to continue conducting business.<\/p>\n<p>\u201cOur courts need to continue to do their business for the sake of the law and public safety, and to the extent they are able to, and it is my responsibility to do everything I can to give the Judicial Council and the Chief Justice the flexibility they need to take actions to meet this moment,\u201d said Governor Newsom.<\/p>\n<p>The California Constitution establishes the Judicial Council as the supreme administrative and rulemaking body for California\u2019s courts.<\/p>\n<p>The Judicial Council, through the Chief Justice, has recently taken actions amid the COVID-19 outbreak, including\u00a0<a href=\"https:\/\/newsroom.courts.ca.gov\/news\/chief-justice-issues-statewide-order-suspending-jury-trials\">suspending jury trials for the next 60 days<\/a>\u00a0and issuing\u00a0<a href=\"https:\/\/newsroom.courts.ca.gov\/news\/court-emergency-orders-6794321\">other emergency court orders<\/a>.<\/p>\n<p>A copy of the Governor\u2019s executive order can be found\u00a0<a href=\"https:\/\/www.gov.ca.gov\/wp-content\/uploads\/2020\/03\/3.27.20-N-38-20.pdf\">here<\/a>, and the text of the order can be found\u00a0<a href=\"https:\/\/www.gov.ca.gov\/wp-content\/uploads\/2020\/03\/3.27.-20-EO-N-38-20-text.pdf\">here<\/a>.<\/p>\n<p>Learn more about the state\u2019s ongoing COVID-19 response efforts\u00a0<a href=\"https:\/\/www.gov.ca.gov\/california-takes-action-to-combat-covid-19\/\">here<\/a>.
