the forced confinement of a person who has contracted or been exposed to an infectious disease.\u00a0 Although it is a long-standing police power of governments, it is seldom used because seldom needed \u2013 sick people generally stay home on their own.\u00a0 When it must be used, it is subject to\u00a0<a href=\"https:\/\/www.poynter.org\/reporting-editing\/2020\/what-do-state-and-federal-laws-say-about-quarantines-and-what-happens-if-you-break-them\/\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.poynter.org\/reporting-editing\/2020\/what-do-state-and-federal-laws-say-about-quarantines-and-what-happens-if-you-break-them\/&amp;source=gmail&amp;ust=1588217125853000&amp;usg=AFQjCNEU_paN-40BjBpwH10VI2OJmrXIFA\">due process<\/a>: the right to contest the order in court, to present evidence that the order is invalid, and to have it vacated.<\/p>\n<p><a href=\"https:\/\/new.thepinetree.net\/wp-content\/uploads\/2017\/08\/Tom_McClintock_Official_Portrait.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-42839\" 400;\">What is happening today is radically different and profoundly un-American: the indefinite and indiscriminate home detention without due process of perfectly healthy people on the pretext that they might catch a contagious disease.\u00a0 While it is true that some people may be infectious without knowing it, that\u2019s no different than a wide variety of other contagious diseases that have been with us for generations and that are far more lethal than Covid-19.<\/p>\n<p style=\"font-weight: 400;\">Although some local jurisdictions prohibited large public gatherings during the\u00a0<a href=\"https:\/\/www.influenzaarchive.org\/\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.influenzaarchive.org\/&amp;source=gmail&amp;ust=1588217125854000&amp;usg=AFQjCNEcT-dmmXKbVHU6MjvzF3kF7mvciA\">Spanish Flu epidemic of 1918<\/a>, never before has any American government attempted to confine an entire population in its homes, order the mass shuttering of businesses, and deliberately plunge tens of millions of Americans into unemployment, poverty and despair.<\/p>\n<p style=\"font-weight: 400;\">This new power, asserted in increasingly arbitrary and aggressive manners by public servants-turned-masters, is antithetical to our\u00a0<a href=\"https:\/\/www.law.cornell.edu\/constitution-conan\/amendment-1\/rights-of-assembly-and-petition\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.law.cornell.edu\/constitution-conan\/amendment-1\/rights-of-assembly-and-petition&amp;source=gmail&amp;ust=1588217125854000&amp;usg=AFQjCNGVDbCBkH4CLyJGmhmhmxboGDr3YA\">First Amendment<\/a>\u00a0right to peaceably assemble and our\u00a0<a href=\"https:\/\/www.law.cornell.edu\/constitution\/fifth_amendment\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.law.cornell.edu\/constitution\/fifth_amendment&amp;source=gmail&amp;ust=1588217125854000&amp;usg=AFQjCNHMDTZPhtgbo3UjnzxvGq50JjCqCg\">Fifth Amendment<\/a>\u00a0right to not be deprived of life, liberty or property without due process of law.\u00a0 The courts recognize some restrictions of these rights, but only by \u201c<a href=\"https:\/\/www.mtsu.edu\/first-amendment\/article\/494\/least-restrictive-means\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.mtsu.edu\/first-amendment\/article\/494\/least-restrictive-means&amp;source=gmail&amp;ust=1588217125854000&amp;usg=AFQjCNGUrDJgIfQpW_d6J8OfTR84oNf48Q\">the least restrictive means<\/a>,\u201d not arbitrary and unreasonable edicts.<\/p>\n<p style=\"font-weight: 400;\">In\u00a0<a href=\"https:\/\/californiaglobe.com\/section-2\/permits-are-denied-for-may-1st-re-open-california-protests-at-state-capitol\/\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/californiaglobe.com\/section-2\/permits-are-denied-for-may-1st-re-open-california-protests-at-state-capitol\/&amp;source=gmail&amp;ust=1588217125854000&amp;usg=AFQjCNEVCyG9ZAjHFxjMfuLn3WsuV_jcKA\">California<\/a>, this abusive power has been used to deny citizens the right to protest the abuse itself.\u00a0\u00a0 In\u00a0<a href=\"https:\/\/reason.com\/2020\/04\/15\/raleigh-police-department-protesting-is-a-non-essential-activity\/\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/reason.com\/2020\/04\/15\/raleigh-police-department-protesting-is-a-non-essential-activity\/&amp;source=gmail&amp;ust=1588217125854000&amp;usg=AFQjCNHk_lpxo9fugCIDuX2ErG4cpDBRTQ\">North Carolina<\/a>, the Raleigh Police Department declared, \u201cProtesting is a non-essential activity.\u201d\u00a0 In\u00a0<a href=\"https:\/\/www.pennlive.com\/news\/2020\/04\/york-county-woman-faces-200-ticket-from-state-police-under-gov-wolfs-stay-at-home-order.html\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.pennlive.com\/news\/2020\/04\/york-county-woman-faces-200-ticket-from-state-police-under-gov-wolfs-stay-at-home-order.html&amp;source=gmail&amp;ust=1588217125854000&amp;usg=AFQjCNH0y-9o3LNq91JebmGee4kvusZjQg\">Pennsylvania<\/a>, police fined a woman $200 for taking a solitary drive in her own car.\u00a0 A\u00a0<a href=\"https:\/\/www.cbs8.com\/article\/news\/health\/coronavirus\/woman-facing-arrest-possible-charges-for-san-diego-covid-19-protest\/509-0221dca6-46a5-4d0a-88f5-3e23903a7107\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.cbs8.com\/article\/news\/health\/coronavirus\/woman-facing-arrest-possible-charges-for-san-diego-covid-19-protest\/509-0221dca6-46a5-4d0a-88f5-3e23903a7107&amp;source=gmail&amp;ust=1588217125854000&amp;usg=AFQjCNGHAcLXWBDyfziv2Qb_La1LmNfqGw\">San Diego<\/a>\u00a0woman is threatened with a $1,000 fine and jail-time for promoting a protest on Facebook.\u00a0\u00a0\u00a0 Ironically, while law-abiding citizens are arrested for exercising rights guaranteed under their Bill of Rights, authorities are releasing\u00a0<a href=\"https:\/\/www.prisonpolicy.org\/virus\/virusresponse.html\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.prisonpolicy.org\/virus\/virusresponse.html&amp;source=gmail&amp;ust=1588217125854000&amp;usg=AFQjCNGDUya5DVzp-eFZgRtxOIBlhryrEw\">thousands of criminals<\/a>\u00a0from prisons and in\u00a0<a href=\"https:\/\/www.officer.com\/command-hq\/news\/21135188\/california-sheriff-effects-of-zero-bail-requirement-could-be-devastating\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.officer.com\/command-hq\/news\/21135188\/california-sheriff-effects-of-zero-bail-requirement-could-be-devastating&amp;source=gmail&amp;ust=1588217125854000&amp;usg=AFQjCNEyoL9qhavZHpZ2Sfwf2w6wmoiRTw\">California<\/a>, forbidding sheriffs from holding a wide class of criminal suspects, including burglars.<\/p>\n<p style=\"font-weight: 400;\">The greatest threat of this newly asserted power is to fundamentally alter the relationship between Americans and their government.\u00a0 It is the age-old question that\u00a0<a href=\"https:\/\/www.youtube.com\/watch?v=o8iNvzzak5U\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.youtube.com\/watch?v%3Do8iNvzzak5U&amp;source=gmail&amp;ust=1588217125854000&amp;usg=AFQjCNHoKqdxDyaTI8uUNCtIAC340KWAsg\">Cecil B.
