City of Angels Declaration of Emergency and Citywide Curfew from 8:30pm to 5am to June 7th (Updated)

Angels Camp, CA…Updated with Explanatory Release…”In light of anticipated protests this weekend, today the City Council of the City of Angels Camp (“City”) issued a Proclamation of Local Emergency (“Proclamation”) and imposed a City wide curfew between the hours of 8:30 p.m. and 5:00 a.m. on Friday and Saturday, June 5-7, 2020. Today’s Proclamation is an important step to allow additional resources to flow into the City, which will assist with the costs of law enforcement as our officers work to ensure that events in the City take place peacefully and without incident, and to protect the health and safety of City residents and businesses. City residents will not be allowed on City streets, walkways, alleys, parks or other public areas during the curfew hours, and any violators will be subject to criminal penalties and fines of up to $1,000. The curfew does not apply to peace officers, firefighters, National Guard and other emergency operations personnel, individuals traveling to their home or workplace or to obtain medical assistance, members of the press, homeless individuals, and delivery or utility services personnel. The City Administrator and the Chief of Police are authorized to extend or modify the curfew as they deem necessary through June 11, 2020.

Residents are encouraged to contact Melissa Eads, 209-736-2181 ext. 5, with any questions or concerns.On June 5, 2020, the City Council of the City of Angels Camp (the “City”) proclaimed a local emergency pursuant to California Government Code section 8630; and, following the death of George Floyd while in custody of law enforcement in Minneapolis, Minnesota on May 25, 2020, protests across the country have occurred, with some protesters starting fires and engaging in vandalism and violence, resulting in at least 40 cities imposing curfews and the activation of the National Guard in at least 23 states, including California, and in Washington, DC.

Recent protest demonstrations in neighboring cities and counties in California have led to civil unrest, violence, arrests, and vandalism of local businesses, riots, looting, and other criminal conduct, and have placed a strain on local law enforcement resources; and California Government Code section 8634 authorizes the governing body of a political subdivision, or officials designated thereby, to promulgate orders and regulations necessary to provide for the protection of life and property, including orders or regulations imposing a curfew within designated boundaries where necessary to preserve public order and safety during a Local Emergency.

To safeguard the rights of peaceful assembly and protest, to protect the safety of City residents, property and businesses as well as emergency and law enforcement providers, it is necessary to establish a curfew to quell violence and destruction of property.

A Citywide curfew is necessary for the immediate preservation of the public peace, health and safety.
NOW, THEREFORE, IT IS HEREBY ORDERED THAT: A. A curfew is imposed within the City to preserve the public order and safety. B. It shall be unlawful for any person, other than those set forth herein below, to be upon any public street, avenue, boulevard, place, walkway, alley, or park, or to otherwise be in any public area or unimproved private realty within the City from 8:30 p.m. through 5:00 am.

This Curfew shall be in effect June 5 to June 7, 2020, commencing at 8:30 p.m. through 5:00 a.m. on each day of the Curfew. The City may renew, amend, or extend this Curfew Declaration in accordance with California Government Code section 8634 and Angels Camp Municipal Code section 2.12.060.
