Objections to Disclosure of Student Records From Local Schools From CDE Lawsuit

Morgan Hill, CA…In April 2012, the Morgan Hill Concerned Parents Association and the Concerned Parent Association (plaintiffs) filed a lawsuit against the California Department of Education (CDE). As part of the litigation, which does not directly involve any specific School District, the plaintiffs are subpoenaing student data from the CDE’s student database.

Nonetheless, as a part of this lawsuit, the court has ordered the CDE to release all data it has collected on general and special education students since Jan. 1, 2008. None of this information may be used outside the context of this lawsuit; no student’s identifying records will be disclosed to the public.

While none of the personally identified information will be publicly shared, it will be used in aggregate form to develop the case. If you do not wish your child’s data to be shared, you may submit an opt-out letter to the court.
