Update to Fish & Game Commission Organization & Structure

San Andreas, CA…AN ORDINANCE AMENDING CHAPTER 2.52 “FISH AND GAME ADVISORY COMMITTEE” TO CLARIFY THE TITLE, DUTIES, POWERS, AND OTHER ISSUES RELATED TO THE CALAVERAS FISH AND GAME COMMISSION. The Board of Supervisors of the County of Calaveras hereby ordains as follows: Section 1. – Chapter 2.52 “Fish and Game Advisory Committee” needs amendment to clarify the title, duties, powers and other issues related to the Calaveras Fish and Game Commission. Section 2. – Ordinance No. 299, 2497 and 3025 are hereby amended and Resolutions No. 75-289, 75-336 and 85-79 are superseded.
Section 3. – Chapter 2.52 of the Calaveras County Code is amended as follows:

Chapter 2.52 FISH AND GAME COMMISSION

2.52.010 – Commission Established.
Pursuant to California Fish and Game Code section 13100(b) there is established in the county the Calaveras Fish and Game Commission, referred to in this chapter as the Commission.

2.52.020 – Membership.
The Commission shall consist of seven members, all of whom shall be registered electors, residing within the county, who shall be appointed by the Board of Supervisors. One commission member shall be appointed from each supervisorial district within the county and two commission members shall be appointed as Members at Large from any supervisorial district within the county.

2.52.030 – Organization.
A. The first meeting of the commission, after the appointment of all of the members thereof, shall be called by the county clerk, and at the time and place selected by the county clerk, the commission shall organize itself.
B. At the first meeting of the commission, the commission shall elect one of its members as chair, elect a secretary, and provide for the time and place of holding meetings and the manner in which special meetings shall be called. The commission may establish rules for the proceedings of the commission.

2.52.040 – Term.
Each member of the commission shall continue to act and to be a member of the commission at the pleasure of the Board of Supervisors, or for such term as might hereafter be prescribed by the Board of Supervisors.

2.52.050 – Powers and Duties.
The Fish and Game Commission shall have the following powers and duties:
A. To advise the Board of Supervisors on all matters affecting the conservation, propagation, preservation, and management of fish and wildlife that is within the jurisdiction of the Board of Supervisors;
B. To coordinate efforts in habitat improvement, public awareness, and resource education within Calaveras County, to provide the citizens of Calaveras County a forum to express their concerns, opinions, beliefs, and views pertaining to the conservation, propagation, preservation, and management of fish and wildlife in Calaveras County, and to perform such other duties and functions as the Board of Supervisors may direct;
C. To make recommendations to the Board of Supervisors regarding the budget for use of the fish and wildlife propagation fund of the county in accordance with the provisions of Chapter 2 (commencing with Section 13100) of Division 10 of the Fish and Game Code,
a. To expend, grant and otherwise provide for the use of the funds as allowed by Fish and Game Code Section 13103 within the budget approved by the Board of Supervisors and in compliance with Chapter 3.28 herein, the County’s Purchasing System; Chapter 3.29, Bidding Procedures for Public Projects, when applicable; and
D. To adopt bylaws and operating procedures to govern the commission in the execution of its duties.
E. In carrying out the duties set forth in this section, the commission shall comply with all ordinances, resolutions, rules and regulations established by the Board of Supervisors concerning all matters within the commission’s authority, including but not limited to contracts, the expenditure of funds and meetings.
F. The commission is subject to the requirements of Government Code section 54950. et seq., also known as the Ralph M. Brown Act.
G. Members of the commission must comply with all applicable provisions of the Political Reform Act, Government Code section 81000 et seq., including but not limited to the filing of conflict of interest forms, and the training required by Assembly Bill 1234.

2.52.060 – Compensation.
The members of the commission shall serve as such without compensation.

Section 4. – Severability.
The provisions of this chapter are declared to be severable. If any provision, clause, word, sentence or paragraph of this chapter or the application thereof to any person, such invalidity shall not affect the other provisions or applications of this chapter.

Section 5. – Environmental Review.
The Board of Supervisors hereby finds that adoption of this Ordinance is not subject to review under the California Environmental Quality Act (Pub. Res. Code section 21000, et seq.) under Title 14, C.C.R. section 15061(b)(3) as it can been seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment as the amendments to Chapter 2.5 are to conform to State law, clarify the title, and purpose and duties of the commission.

Section 6. – Effective Date.
This ordinance shall take effect thirty (30) days from the date of its passage and shall be published once within fifteen (15) days of its passage in a newspaper published in the County of Calaveras with the names of the supervisors voting for and against same.
