Boards consideration to approve an MOU with Mark Twain UESD for Extended School Year (ESY) summer program 

Description

Due to staffing shortages for the extended school year (ESY) program, VUSD is entering into an MOU with Mark Twain SD to meet the needs of our special education students for the summer

MEMORANDUM OF UNDERSTANDING 2022 EXTENDED SCHOOL YEAR SERVICES 

This Memorandum of Understanding (“MOU”) is entered into this 13th day of June by and between the Vallecito Unified School District and (VUSD) and Mark Twain Union Elementary School District (MTUESD), collectively referred to as “the parties.” 

  1. 1. Term & Effective Date. The term of this MOU is June 13, 2022 – July 15, 20 This MOU is effective following approval by the governing board of the Resident District. 2. Termination. In the event that MTUESD is unable to staff or otherwise operate ESY for the Resident District, this MOU may be terminated with ten (10) days written notice to the Superintendent of VUSD. 3. Purpose & Obligations. The purpose of this MOU is to enable VUSD to offer Extended School Year (ESY) services to students with a qualifying Individual Education Plan (IEP) indicating in-person, on-site ESY at Mark Twain Elementary School. 
  2. A. This MOU applies only to ESY for such students for the summer ESY program operating between June 13, 2022 and July 15, 20 Monday – Friday services, 8 a.m. – noon during this period with June 20 and July 4, observed as holidays. 
  3. VUSD is responsible for providing arranging and being fiscally responsible for transportation to and from Mark Twain Elementary School and the point of pick-up and drop-off that VUSD and parent/guardian agree to. 
  4. MTUSD is responsible for providing 1 breakfast, 1 lunch, and 1 snack each day ESY is in session to the students attending from VUSD, at no cost. 
  5. MTUESD may revoke the attendance of students in its ESY for the reasons outlined in ED CODE 48900, including, but are not limited to, for failure to demonstrate acceptable behavior. 
  6. VUSD will incur the following financial costs for services rendered under this MOU, regardless of student attendance: 

Teacher cost per student: $990.00 Paraprofessional cost per student: $608.00 

Total Cost per student is $1598.00 due to MTUESD, PO BOX 1359, 681 Tuolumne Ave, Angels Camp, CA 95222 on or before July 15, 2022. 

  1. F. This MOU is a stand-alone agreement for 2022 ESY, June 13 – July 15, 2022 only and does not replace any other agreements to which the parties are signatories. 
  2. Compliance with law. The parties shall be subject to and comply with all applicable federal, state, and local laws and regulations with respect to their performance under this MOU, including but not limited to, adopting and implementing written policies pursuant to Education Code section 51747. 
  3. Nondiscriminatory Services. The parties agree that all education services provided under this MOU shall be available to all qualified persons regardless of age

sex, race, religion, color, national origin, or ethnic background, or disability, and that none shall be used in whole or in part, for religious worship or instruction. 

  1. Independent Contractor Status. This MOU is by and between two independent contractors and is not intended to and shall not be construed to create the relationship between the parties of agent, servant, employee, partnership, joint venture, or association. 
  2. Authorization. The undersigned parties represent that they are authorized to execute this MOU on behalf of their respective principals. 
  3. Execution in Counterparts. This MOU may be executed in counterparts, each of which will be treated as an original and all of which together are to be considered one and the same MOU. Facsimile signatures or scanned copies of signatures are binding and are to be considered original signatures.
