DISCUSSION/SUMMARY:
On March 30, 1973, after almost 10 years of battle, the last of the US
troops were airlifted from the imploding nation of South Vietnam, thereby
completing the total withdrawal of combat troops. Of the 3.4 million who
served in Vietnam, 58,220 never returned home and 304,000 were
wounded. Seventeen hundred individuals remain listed as missing or killed
in action. In addition, countless others have carried the invisible wounds of
war; the atrocities they witnessed, the friends they lost, and the chemicals
and shrapnel they will forever carry in their bodies.
The reception upon returning home after fighting a war some were drafted
to fight, others were sworn to fight, was not what the beleaguered soldiers
expected. Gone were the days of the ticker tape parades and American
pride that was showered upon the WWII veterans when they returned
home. In its place were lines of protestors – unable to differentiate between
the war and the troops who served. As a result of the mistreatment that
many experienced upon their return, many chose to not wear their
uniforms, the same uniforms they had worn just days before in the jungles
of Vietnam with pride.
In 2007, both the US Senate and the US Congress passed resolutions
proclaiming March 30th as National Welcome Home Vietnam Veterans
Day. On March 28, 2010, then California Governor Arnold Schwarzenegger

signed AB 717 establishing an annual “Welcome Home Vietnam Veterans
Day” on March 30. Staff recommends that the Board of Supervisors also
proclaim March 30th as Welcome Home Vietnam Veterans Day in

Keep It California is a non-partisan political action committee that has offered support and
information to counties that have been approached by the State of Jefferson (SOJ) and no new
counties have officially agreed to join SOJ since our group started last April. Now, we would like
to build on the regional relationships that we have established to develop a coordinated effort to
improve understanding and representation of rural California issues in Sacramento.
Their top four issues for 2016 are to advocate for: 1) full payment on state Payments in Lieu of
Taxes (PILT); 2) expansion of broadband internet service in rural areas; 3) development of
biomass energy facilities to reduce fire danger and create jobs and 4) improvement of rural
healthcare services.

DISCUSSION/SUMMARY:
The California Board of Corrections requires provision for medical services by qualified
professionals in local detention facilities as defined in Minimum Jail Standards, Title 15 and
Article 10.
In April of 2015, the County advertised for Request for Proposals for qualified vendors to
provide medical services for the inmate population in the Calaveras County Correctional Facility
for the term of July 1, 2015 through June 30, 2018. The legal notice of the opening of the bid
was advertised in multiple newspapers including all tri-county area newspapers and Central
Valley newspapers. The County also mailed notification of the Request for Proposals for
medical services to Mark Twain Medical Center, Sonora Regional Medical Center and Amador
Sutter Hospital.
The Request for Proposals closed in May of 2015 with only one bid received from California
Forensic Medical Group (CFMG). The bid submitted met all required components of the
Request for Proposals and included a fee schedule of $485,881.00 per annum to be adjusted
based on the percentage change in the medical care component of the Consumer Price Index
CPI – All Consumers – West Urban Region.
The CFMG is the current provider of medical services in the Calaveras County Correctional
Facility and has been the provider since May 10, 1999.

Jail Medical Agreement

Financing for the inmate medical services contract is paid out of the Jail Budget Unit (10100380)
and is a direct General Fund cost. The amount of the contract is already budgeted in the FY
2015/2016 budget and no adjustment to Jail appropriations is needed.
ALTERNATIVES:
The Board could choose not to approve an inmate medical services contract with California
Forensic Medial Group. This is not recommended. The County is required by law to provide
adequate medical services to inmates within our correctional facility.

Adopt a Resolution continuing a Local State of Emergency on Tree Mortality
DISCUSSION/SUMMARY:
On January 17, 2014, the Governor of the State of California proclaimed a Drought State of
Emergency as the State was and continues to experience the most severe drought in known
history–with four years of below average rain and snow fall. The drought is causing widespread
tree mortality and a major bark beetle epidemic.
On July 31, 2015, Governor Brown proclaimed a State of Emergency due to a series of wildfires
statewide. He indicated that drought conditions have increased the State’s risk of wildfires and
caused millions of trees to die. On October 30, 2015, Governor Brown further proclaimed a
State of Emergency due to the vast tree mortality within several regions of the state.
As a result of the Butte Fire, tree mortality will likely be significantly enhanced in Calaveras
County due to dead trees giving off the chemical Terpene, which attracts the bark beetle. The
bark beetle is responsible for the tree mortality currently being witnessed in the State, and
although the beetle is attracted to the chemical given off by the dead trees, they will only attack
surrounding living trees.
On November 24, 2015, the Board of Supervisors adopted the State of Emergency for
Calaveras County due to widespread tree mortality and a major bark beetle epidemic.
On December 8, 2015, December 22, 2015, January 5, 2016, January 12, 2016, January
26, 2016, February 9, 2016, February 23, 2016, March 8, 2016 and March 22, 2016 the
Board of Supervisors continued the State of Emergency for tree mortality.
The US Forest Service and Cal Fire have reported an estimated 22 million dead trees due to the
drought and bark beetles. Unless the risks posed by dead, dying and diseased trees are
immediately abated, there will be a significantly increased risk to life and property (e.g. trees
falling on homes), and interruption of essential services (i.e. roads, power, water, sewer,
communications). The magnitude of pervasive tree mortality represents a threat that is beyond
the capacity of the County (public and private) services, personnel, equipment and facilities and

requires coordination and assistance from State and Federal agencies.
FINANCING:
Adoption of this resolution will have no impact on the County General Fund.
ALTERNATIVES:
The Board could choose not to adopt the resolution proclaiming a State of Emergency, however
staff recommends that the resolution be adopted in order to access assistance as cited in the
Governors October 30, 2015 proclamation.

Calaveras County due to pervasive tree mortality.
WHEREAS, California Government Code section 8630 empowers the Board of
Supervisors to proclaim the existence or threatened existence of extreme peril to the safety of
persons and property and are or are likely to be beyond the control of the services, personnel,
equipment and facilities of this County; and
WHEREAS, on January 17, 2014, the Governor of the State of California proclaimed a
Drought State of Emergency as the State is experiencing the most severe drought in history,
with four years of below average rain and snow fall; and
WHEREAS, California is in its 4th year of record drought resulting in widespread tree
mortality and a major bark beetle epidemic; and
WHEREAS, on July 31, 2015, Governor Brown proclaimed a State of Emergency due to
a series of wildfires statewide, citing drought conditions which have increased the State’s risk of

does hereby find that the aforesaid conditions of extreme peril warrant and necessitate the

BE IT FURTHER RESOLVED that the Calaveras County Board of Supervisors concurs
with the Governor’s Proclamation of a State of Emergency due to tree mortality.
BE IT FURTHER RESOLVED that Calaveras County also requests the State of
California assist in the coordination of resources as specified in the Governor’s October 30,
2015 Proclamation of a State of Emergency due to tree mortality as a result of bark beetle
infestation.
BE IT FURTHER RESOLVED that Calaveras County also requests the State of
California to waive regulations that may hinder response and recovery efforts, make available
assistance under the California Disaster Assistance Act or any other state funding (e.g. SRA
Grant Funds, AB32 Funds, etc…), and to expedite access to federal resources and any other
appropriate federal disaster relief programs (e.g. USAD Funding, etc…).
BE IT FURTHER RESOLVED AND ORDERED that said local State of Emergency shall
be deemed to continue to exist until its termination is proclaimed by the Board of Supervisors,
County of Calaveras, State of California.

DISCUSSION/SUMMARY:
On September 10, 2015 the Board of Supervisors declared a Local State of Emergency for
Calaveras County due to the Butte Fire pursuant to the Emergency Services Act (Gov. Code
8558 (c)) and Chapter 2.72 of the Calaveras County Code.
The County’s Emergency Operations Plan requires that the declaration of a Local State of
Emergency be reviewed every 14 days. State law also requires regular review until the date
of termination.
On September 22, 2015, September 29, 2015, October 13, 2015, October 27, 2015,
November 10, 2015, November 24, 2015 December 8, 2015, December 22, 2015, January
5, 2016, January 12, 2016, January 26, 2016, February 9, 2016, February 23, 2016, March
8, 2016 and March 22, 2016 the Board of Supervisors continued the State of Emergency for
Calaveras County due to the ongoing needs of the public in the aftermath of the Butte Fire.
The Butte Fire has burned over 71,000 acres and 475 homes in Calaveras County have
been lost (along with several outbuildings). The County remains strongly dependent upon
mutual aid and multi-agency disaster relief programs and has a continued need for quick,
flexible decision-making when it comes to responding to the ongoing critical impacts of the
Butte Fire.
It is recommended that the Local State of Emergency continue due to the ongoing
extraordinary needs of the county due to the Butte Fire.
FINANCING:
At this early juncture, no costs have been determined.
ALTERNATIVES:
The Board could choose not to continue the Declaration of a Local State of Emergency for
Calaveras County. This is not recommended given the seriousness of the Butte wildland fire

WHEREAS, on September 10, 2015, the County of Calaveras found that, due to the
Butte Fire, a condition of extreme peril to life and property does currently exist in Calaveras
County during the period beginning on September 9, 2015; and,
WHEREAS, section 2.72.060 of the Calaveras County Code empowers the Board of
Supervisors to proclaim the existence or threated existence of a local emergency when said
county is affected or likely to be affected by a public calamity; and,
WHEREAS, the Calaveras County Emergency Operations Plan requires twice-monthly
review of a local state of emergency and the California Emergency Services Act requires at
least monthly review of a local state of emergency; and,
WHEREAS, on September 22, 2015, September 29, 2015, October 13, 2105, October
27, 2015, November 10, 2015, November 24, 2015, December 8, 2015, December 22, 2015,
January 5, 2016, January 12, 2016, January 26, 2016, February 9, 2016, February 23, 2016,
March 8, 2016 and March 22, 2016 the Board of Supervisors continued the State of Emergency
due to the ongoing needs of the public in the aftermath of the Butte Fire; and
WHEREAS, the Board of Supervisors does hereby find that conditions of extreme peril
to the safety of persons and property continue to exist within the County of Calaveras caused by
the Butte Fire and, therefore, necessitate the continuation of the local emergency; and
WHEREAS, local resources remain insufficient to cope with the effects of said
emergency; and
WHEREAS, the Butte Fire has created extreme financial hardship for the residents of
Calaveras County;
THERFORE BE IT RESOLVED, that the Calaveras County Board of Supervisors does
hereby continue the September 10, 2015, Declaration of a Local Emergency in Calaveras
County as a result of the September 9, 2015, wildland fire that has caused damage to County
residents and their properties.
IT IS FURTHER RESOLVED that, Calaveras County does not have adequate resources
to respond, AND IT IS REQUESTED that the State of California provide direct assistance to
remove hazardous wastes from property sites within the Butte Fire area that are toxic,
flammable, corrosive, or reactive because of the imminent threat such wastes pose to public
health and safety.

DISCUSSION/SUMMARY:
On September 17, 2015, Calaveras County Environmental Health Officer Jason Boetzer and
Health Officer Dean Kelaita, MD jointly requested that the Board of Supervisors proclaim a
Local Health Emergency in Calaveras County pursuant to Health and Safety Code (H&S)
Section 101080 due to environmental and physical health hazards resulting from the Butte Fire,
which started on September 9, 2015, has burned over 70,000 acres, and has so far destroyed
475 homes.
A Local Health Emergency, as defined in the Health & Safety Code, exists because the burning
and collapse of residences, outbuildings, and other structures has likely resulted in dangerous
and unstable conditions related to both hazardous and non-hazardous materials. The fire has
also likely damaged and/or contaminated residential wells, and there are additional hazards
related to foods, medicines, and other perishables that have been spoiling due to the lack of
electricity required for refrigeration or freezing.
On September 22, 2015 the Board of Supervisors adopted a resolution proclaiming a Local
Health Emergency in Calaveras County. State law requires that the declaration of a Local
Health Emergency be reviewed every 14 days until the date of termination. On September
29, 2015, October 13, 2015, October 27, 2015, November 10, 2015, November 24, 2015,
December 8, 2015, December 22, 2015, January 5, 2016, January 12, 2016, January 26,
2016, February 9, 2016, February 23, 2016, March 8, 2016 and March 22, 2016 the Board
of Supervisors continued the Local Health Emergency.
The attached Revised Declaration of Local Health Emergency allows the Environmental Health
Department, the County Health Officer, and the Calaveras Health and Human Services Agency
to garner much-needed resources and mutual aid to meet the health and safety needs of those
who have been displaced by the fire, including those who are now anxious to return to
properties which may not currently be safe for them.

A declaration of Local Health Emergency also authorizes the Director of Environmental Health
and the County Health Officer to:
 Require disclosure of any potentially toxic material that may have been released, spilled,
or escaped during the fire
 Transmit information about potentially toxic exposure to state or local agencies
responding to the health emergency or treating its victims
 Sample, analyze, or otherwise determine the identifying and other technical information
necessary to abate the hazard and protect public health
FINANCING:
Continuing the declaration of a Local Health Emergency allows the County to receive aid and
reimbursement it may not otherwise be qualified to receive.
ALTERNATIVES:
The Board may choose to not continue the Local Health Emergency, but this is not
recommended because the continuation of the emergency allows the Health Officers to move
quickly to procure necessary information and resources to mitigate the hazards resulting from
the fire.

RESOLUTION CONTINUING THE EXISTENCE OF A
LOCAL HEALTH EMERGENCY JOINTLY PROCLAIMED BY
THE COUNTY ENVIRONMENTAL HEALTH DIRECTOR AND
COUNTY HEALTH OFFICER
WHEREAS, California Health & Safety Code (H&S) Section 101080 empowers the local
Director of Environmental Health to declare a Health Emergency within the jurisdiction
whenever a release, spill, escape, or entry of waste is hazardous or may become hazardous
because of a combination or reaction with other substances or materials in a manner the
Director determines to be an immediate hazardous to public health; and
WHEREAS, Section 101080 of the California Health and Safety Code empowers the
Local Health Officer to proclaim the existence or threatened existence of a local health
emergency when the Local Health Officer reasonably determines that the waste is a hazardous
waste or medical waste, or that it may become a hazardous waste or medical, subject to
ratification by the Board of Supervisors within seven days and reaffirmation every fourteen days
thereafter until such health emergency is terminated; and
WHEREAS, the Butte Fire has burned 818 structures, including 475 residences within
the jurisdiction, giving rise to an imminent public health threat due to the burning, spilling,
escaping, and releasing of hazardous materials contained therein and the toxicity of the burned
debris and resulting ash; and
WHEREAS, the Butte Fire has forced the extended evacuation of residents from
thousands of homes where, in combination with a loss of power to these homes, the spoilage of
perishable food and medical items gives rise to an imminent and proximate threat of
communicable and/or non-communicable disease; and
WHEREAS, the Butte Fire is likely to have damaged, destroyed, and/or contaminated an
unknown number of wells which supply drinking water at properties through which the fire has
burned, giving rise to an imminent and proximate threat of disease and/or release of a chemical
agent or toxin; and
WHEREAS, the Calaveras County Health Officer does hereby find:
1. That conditions beginning on September 9, 2015, have created and are continuing to
create debris, which may be or which may become hazardous waste and a threat to
public health; and
2. That the threat to public health creates the immediate need to facilitate assistance and
undertake preventive measures to protect the health of people and the environment and
to inform the affected public of any potential health issues associated with the debris
created by the Butte Fire, thereby necessitating the proclamation of the existence of a
local health emergency; and
3. That assistance to private property owners and to the County is needed for timely
implementation of necessary preventive measures to protect public health and the
environment; and
4. That the scope and breadth of the Butte Fire, including but not limited to the many
residences that have been damaged or destroyed creates an imminent threat to public

health in that there are apparent hazardous substances akin to any hazmat incident,
which require a rapid response to be safely removed from the sites of burned structures;
and
5. That the potential advent of the rainy season offers little time to mitigate further
environmental contamination, including contamination of the watershed, meaning that
time is of the essence in removing hazardous materials from property sites; and
6. That immediate action is necessary to remove toxic, flammable, corrosive, and reactive
substances, including toxic burned debris and ash, from property sites within the Butte
Fire area.
WHEREAS, the Board of Supervisors does hereby find that the Butte Fire has caused
conditions of extreme peril to the health, safety and welfare of persons and property within the
County of Calaveras as described in H&S Section 101080 with respect to both environmental
and physical health, thereby necessitating the Proclamation of the existence of a Local Health
Emergency; and
WHEREAS, local resources are unable to cope with the effects of this health emergency;
and
NOW, THEREFORE, IT IS HEREBY PROCLAIMED, that a Local Health Emergency
continues to exists in Calaveras County (per Attachment A); and
IT IS FURTHER ORDERED that, Supervisor Cliff Edson, Board Chair, and/or Shirley
Ryan, County Administrative Officer, remain designated as the authorized representatives of the
County of Calaveras for the purpose of receipt, processing, and coordination of all inquiries and
requirements necessary to obtain available State and Federal assistance with respect to this
emergency condition; and
IT IS FURTHER PROCLAIMED AND ORDERED that during the existence of said local
emergency, the powers, functions, and duties of the Local Health Officer shall continue to be
those prescribed by state law, including the provisions of Section 101085 of the California
Health and Safety Code, and by any ordinances and resolutions of the County approved by
the Board of Supervisors; and
IT IS FURTHER PROCLAIMED AND ORDERED that immediate action is required to
remove hazardous wastes from property sites within the Butte Fire area that are toxic,
flammable, corrosive, or reactive because of the imminent threat such wastes pose to public
health and safety.
IT IS FURTHER PROCLAIMED that, Calaveras County does not have adequate

DISCUSSION/SUMMARY:
On March 8, 2016 the Board of Supervisors approved the purchase of a Capital Asset for new a
copier/scanner/printer for Human Resources (10100021). At that time of Mid Year Technical
Adjustments, there were not sufficient funds in the Duplication Fund (10100090) to cover the
cost of the copier so the cost of the Capital Asset was to be funded from savings from the
Insurance Budget Unit (10100150). With the deposit into the Duplication Fund from quarterly
departmental charges, there are now sufficient funds to pay for the copier for Human Resources
out of the Duplication Budget Unit.
The Board also approved on March 8, 2016 the purchase of a Capital Asset for a
copier/scanner/printer for the Assessor (10100050) during Mid Year Technical Adjustments.
The Assessor is asking to increase the cost of the Capital Asset by $1,000.00 to include the
cost of sales tax of the Capital Asset for an amount not to exceed $13,500.00.The cost will be
paid by salary savings in the Assessor’s budget.
The Administrative Office is recommending the Board approve the purchase of the Capital
Asset in the Duplication Fund and to increase revenue and expenditures by $17,000.00 to the
Duplication Budget with a transfer from the Duplication Fund (54740000); requiring a 4/5s vote
of the Board. The Administrative Office is also recommending the Board approve an increase to
the amount of the Capital Asset in the Assessor’s Budget by $1,000.00 for an amount not to
exceed $13,500.00.
FINANCING:
The increase to appropriations in the Duplication Budget will be financed with a transfer from the
Duplication Fund. The increase cost of the Capital Asset in the Assessor’s Budget will be

ALTERNATIVES:
The Board could choose to not fund a copier for Human Resources from the Duplication Fund

RECOMMENDATION:
The Board of Supervisors declare the equipment listed below as surplus and subject to disposal

DISCUSSION/SUMMARY:
In accordance with Government Code §25504 and Chapter 3.28, Calaveras County Code,
Purchasing System, the County Administrative Officer has the responsibility for the disposition
of assets found by the Board of Supervisors to no longer be suitable for county use. The
County Administrative Office has evaluated the equipment listed below and determined that
they are no longer suitable for continued county use.
The County Administrative Office recommends the Board declare the following equipment as
