Notice of Election and Notice to Submit Arguments

San Andreas, CA…NOTICE OF ELECTION AND NOTICE TO SUBMIT ARGUMENTS. NOTICE IS HEREBY GIVEN that an all-mail Special Tax Election will be held on May 7, 2019 for both Ebbetts Pass Fire Protection District and Appaloosa Road Community Services District for the purpose of voting on the following measures:

Measure A
To sustain the Ebbetts Pass Fire District Paramedic Engine and Station 3 Ambulance programs, shall the measure adding a special tax of $134.00 per improved property with a $6.28 annual increase for the first ten years and $43.00 per unimproved property with a $2.42 annual increase for the first ten years, without expiration, generating $1,254,107-$1,852,800 in revenue and increasing the District’s appropriations limit equal to revenue received for the next four years, be adopted?

Measure B
Shall the measure increasing the special tax from $75/year to $175/year, without expiration, for taxable parcels on Appaloosa Road, Chestnut Court, Chestnut Way, Dunn, Filly, Hunter, Paint, Shetland and Welsh Roads, constituting the Appaloosa Zone of the Appaloosa Road Community Services District, thus raising approximately $14,000 of additional revenue annually, to restore the purchasing power of funds lost to inflation since the last tax increase in 2005, and to provide additional funding for road improvements, be adopted?

NOTICE IS FURTHER GIVEN that arguments for or against the above measures will be accepted in the office of the County Clerk, Election Division, at 891 Mountain Ranch Road, San Andreas, CA 95249. Arguments shall not exceed 300 words in length and shall be titled either “Argument In Favor Of Measure ___” or “Argument Against Measure ___.” Arguments must be filed no later than 5:00 p.m. on, February 19, 2019.

A ballot argument shall not be accepted unless accompanied by the name or names of the person or persons submitting it or, if submitted on behalf of an organization, the name of the organization and the name of at least one of its principal officers. No more than five signatures shall appear with any argument. All arguments must also be accompanied by a statement that the argument is true and correct to the best of his/her/their knowledge and belief.

If more than one argument for and one argument against the measure is received, the selection will be made pursuant to the provisions of the Elections Code 9166.

NOTICE IS FURTHER GIVEN that if an argument in favor of and an argument against the measure is submitted, copies will be mailed to the respective authors. The authors may prepare and submit a rebuttal argument not to exceed 250 words in length. Rebuttal arguments must also be accompanied by a statement that the argument is true and correct to the best of his/her/their knowledge and belief. The deadline for filing a rebuttal argument will be 5:00 p.m. on March 1, 2019.
